Villa Rental Terms & Conditions for Acqua Blu, RedHawk, Vita Allegre,  Caribe Getaway, Country House Studio, and Country House Cottage

BOOKING

This vacation rental agreement becomes a binding agreement when you sign it, send it to vivillasstj@gmail.com  and your deposit is received, or we receive your valid credit card information. Only after all these terms are met is your reservation confirmed.

DEPOSIT & FINAL PAYMENT: We accept PayPal, Venmo, Master Card, Visa, and Discover Credit Cards along with bank money orders, and personal checks. To secure your reservation a 50% deposit of the rental rate and the $500 refundable security deposit or $90 for damage insurance is required and must be received by us within 7 days after your request to book the property. Failure to make this payment subjects your reservation to automatic cancellation. Credit card and like payments incur a 3% surcharge.

The balance due of rent, taxes and miscellaneous charges, must be paid in full at least 90 days prior to your arrival.

CANCELLATION POLICIES: All cancellations and / or any request for changes to your reservation must be made in writing. This includes a change in the number of persons, no-shows, late arrivals, and early departures and re-scheduling. are

Guests who abandon the Villas without authorization from the Villas agree they have no rights to compensation.

ALL PAYMENTS ARE NON REFUNDABLE with the following conditions.

If they are  requested 90 days before arrival, we will return 80% of your payments only if we re rent the villa.

If less than 90 days there will be no return of monies.

We suggest you purchase travel insurance to cover any events which could cause you to cancel. This is especially important in hurricane season, but highly recommended for all bookings.

While this may seem like a very harsh policy we ask you to understand that assembling a group to fill a villa is a complicated matter and usually just cannot happen in a short term.

DAMAGE TO VILLAS

On all of our villas there is a $500.00 refundable fee or $90 for damage insurance which covers you for non malicious damage and breakage. You are responsible for telling us of any damage that occurs during your stay as hidden damage is a serious problem.

Aggressive and or malicious damage is not covered by this non-refundable fee. You hereby agree to pay the Villas the cleaning or replacement costs for all damages to personal property or to the real estate, which may occur as a result of your occupancy, excluding normal wear and tear. The funds due (if any) will be billed to your credit card that we hold on file.

Guest shall hold the Villas harmless from all claims or causes of actions arising from the rental and occupations of the residence. Participation in any activity while at this villa is voluntary and performed at Guest own risk. Guest agrees to release, discharge and hold harmless the Villas/the Owner from any /all liability, loss, damages, costs and expenses (including attorney’s fees), claims, suits and demands arising from any accident, injury, loss (personal or physical) or damage whatsoever, during Guest stay at this villa. Guest agrees to waive any right to bring a legal action arising out of or relating to participation by Guest in any activities or use of the equipment, facilities or any services provided. This waiver includes but is not limited to use of all equipment, recreational facilities, pool, bath tub, residential areas, sidewalk/paths, trails or passageways to the villa.

Locked pantries and closets are reserved for the use of the villa owner and are not included in this rental.

VILLA FUNCTIONS such as a dinner party, wedding, reception, etc. require prior written consent of the Villa Management and Guest must pay a function fee (up to $3000) plus an event security deposit and sign a separate contract. Guest will pay any fines or penalties resulting from non-compliance.

All caterers working in the villa must be pre-approved by the Villas, be fully licensed and insured (please contact Concierge Services).

VILLA LIABILITY: Again, we strongly advise you to purchase Travel Insurance especially when traveling during hurricane season, July-November. St. John’s wonderful location puts us at risk for hurricanes. Guests may need to be evacuated for their safety. The Villas are not responsible for airline changes, the cost of alternate accommodations or cancellation fees and no refunds/adjustments can be offered in this event.

If the Villas become unavailable due to its sale or irreparable damage by an act of God, the Villas will make every effort to re-reserve a similar property. If similar accommodations cannot be found, a refund will be issued.

VILLA KEYS: The Villas shall charge Guest $35.00 for each set of lost or mishandled keys.

DRUGS AND HAZARDOUS MATERIALS: Guest and members of his party shall not use or permit to be brought into the villa any illegal substances, inflammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property.

CAPACITY OF VILLAS: The total number of persons allowed in the villa at any one time is restricted to the number of persons scheduled and paid for. Should a group misrepresent themselves, they will be required to pay for the excess persons immediately, or shall vacate the villa without refund. Exceptions are made only for infants; if sleeping in a baby crib, they are not included in the villa’s total headcount.

You have booked by room with an understanding that it is double occupancy. If such is not the case, the bill will have to be adjusted to compensate for single occupancy of a room.

QUIET ENJOYMENT AND PARTIES: The Villas wish to maintain a family atmosphere for the quiet enjoyment of Guests. We rent to family groups and responsible adults only; absolutely NO house parties or events such as weddings are allowed without prior WRITTEN permission from the Villa management. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood. Pool funcitons and loud music must end by 10:00 PM.

MINIMUM STAYS: In Season, a 7-day minimum stay is standard.

CONCIERGE/GREETERS: One complimentary greeter, who will direct you to the house is provided. Additional greeters must be scheduled in advance and prepaid at $150  per additional greeting.

MAID SERVICE: The villas are cleaned before and after your arrival. Additional maid service is available if booked and paid for in advance: Rates start at $150.00 for a 3 hr minimum, $35/hr. thereafter.

SPECIFIC RULES: Please note the following rules that are strictly enforced.

You must remove all your garbage. If you do not, we will charge you $35.00 per bag to dispose of it.

No furniture or bedding is to be moved without written permission. If it is there will be a $60.00 per hour charge to move it back to it’s original position.

NO SMOKING inside the Villas. While smoking is allowed outside the villas all butts must be policed or the cleanup will be charge at $60.00 per hour. NO ONE wants this job and it shows great disrespect for our Island and home

COVID-19 RELEASE AND HOLD HARMLESS AGREEMENT

The current world-wide Coronavirus (COVID-19) pandemic and government mandated “shelter in place/stay at home” or similar orders throughout the United States Virgin Islands and in many other communities in the United States and throughout the world underscore the risks associated with individuals booking, renting, leasing, occupying, viewing or inspecting real property. It also emphasizes the risks to Sellers and Owners and Tenants, including leisure tourists, business travelers, inter-island travelers, “stay-cationers” and others who enter property which they lease, rent, book, own or otherwise occupy for short, medium or long-term stays. The undersigned understands that exposure to disease-causing organisms, such as COVID-19, and contaminated objects, as well as personal contact with interested parties, including but not limited to booking agents, real estate agents, occupants, owners and others associated with the sale, lease, rental or purchase of property involve a certain degree of risk that could result in illness, permanent disability or death. By signing below, I agree to release and hold-harmless Dale Miller and V.I. Villas and their agents, contractors, employees, officers, and vendors from and against all claims demands, actions, causes of action and attorney’s fees for compensatory or punitive damages and liability of any kind or nature whatsoever arising from or relating to exposure to disease-causing organisms, such as COVID-19, and contaminated objects, as well as personal contact associated with viewing, inspecting, booking, leasing and occupying property owned or occupied by others, or allowing others to enter such property for the purpose of use or occupancy. The Release and Waiver shall be construed in accordance with the laws of the U.S. Virgin Islands. The parties agree to St. Thomas, U.S. Virgin Islands as the sole venue and forum of any dispute arising hereunder. Any such dispute shall be arbitrated in accordance with the Commercial Rules of the American Arbitration Association.

This waiver and the rest of this agreement is accepted to be DONE in the District of St. Thomas and St. John, U.S. Virgin Islands on this __________ day of ___________________, 202___.
